Terms of Website Use

These terms of use have been created by Gavin MacDonald Photography for the information of visitors to our website (www.gavinmacdonaldphoto.com) and form the conditions which govern use of our website whether as a guest or a registered user.

Use of our site includes accessing, browsing, or registering to use our site or services.

Please read these terms carefully before using our site; by using our site, you confirm you have accepted these terms of use and that you agree to comply with them.

1. Intellectual Property Rights; Authorised & Unauthorised Use of Images & Content.

  1. All images and text contained on this website remain the property of Gavin MacDonald Photography and is protected by United Kingdom and international copyright laws. Content may not be downloaded, reproduced, copied, projected, or used in any way without express written permission.

  2. Various tracking systems are in place to identify unauthorised use. Unauthorised users agree that they will be liable for a standard £200 + VAT minimum administration charge per image plus reproduction fees at the sole discretion of Gavin MacDonald Photography.

 

2. Website Orders & Payments

When you place a order on our website, we will e-mail you to acknowledge receipt of your order and payment.

3. Website Order cancellations and returns

  1. Once an image, book or calendar print order has been sent to print, a refund is not option is not available.

  2. If an item has been damaged in post or has a print error, a replacment or full refund will be provide once we receive return of the damaged item.

4. Payment Methods

  1. All payments on this website are processed automatically via Paypal. Paypal offers an industry standard secure on-line payments system. You can use any credit or debit card to pay via Paypal and can even make payments if you do not have an account.

  2. UK bank transfers can also be accepted as a method of payment. Please contact us if you would like to pay using either of these systems.

5. Ordering Prints

5a. Packaging

You can be assured that your order will be suitably packaged to prevent damage during transit. Items will be packaged in the following ways:

  1. Photographic print orders will be packaged flat, wrapped in cellophane for protection or in hard tubes depending on the image size.

  2. Special requested framed print orders will be bubble wrapped, and packaged within protective cardboard

  3. Book orders will be protected in a cardboard book mailer

  4. Calendars will be packaged in a board backed envelope

If you have any questions relating to the packaging of orders, please contact us. 

5b. Processing & Delivery

  1. We endeavour to despatch all print orders within 10 working days of placing an order. If for any reason there is a delay, we will contact you by email to advise. In practice the majority of our orders are despatched in less than 10 working days.

  2. Delivery is included for all UK orders. Photographic Prints are despatched directly from the printers either by Royal Mail or courier, depending on size. Framed prints will be despatched via courier.  You will be emailed to advise when your print has been shipped.

  3. If you would like to order an item to be delivered to an international address please contact us for shipping costs and information. 

6. Pre-Orders

  1. Pre-orders will be sent to print on the date stated on the website. As soon as this item has been sent to print a refund is not option is not available.

  2. If an item has been damaged in post or has a print error, a replacment or full refund will be provide once we receive return of the damaged item.

  4. Full payment is due at the time of Pre-Order.

  5. A full refund can be given if requested before the item has been sent to print on the date stated on the website.

 

7. Returns Policy

We take pride in our customer service both in the quality of our prints and in the efficiency with which we process orders. However, if for any reason you are not satisfied with the quality of your order please contact us to describe the imperfection(s) and return the item(s) within 7 days of receipt. Upon receipt and after satisfactory inspection of imperfection(s) you will be offered a choice of either a replacement, or a full refund.

8. Tuition & Workshops

8a. Payments


All workshop payments secure the workshop booking for the specific date of that workshop.

9. Cancellation: Tuition & Workshops

9a. One to One Tuition

  1. If you find that you can’t make it on the day of the course but you give us at least 48 hours notice, you will be given the choice of a full refund or a credit for another course.

  2. If you can’t make it on the day but you give us at least 12 hours notice, you will be given a refund of 80% of the total paid for the course.

  3. If you notify us less that 12 hours in advance, unfortunately, we will not provide a refund.

  4. If we are only notified less that 12 hours in advance, or if you fail to present yourself at the course then we regret that there will be no refund and you will have to pay a full fee to attend this class again.

  5. In the unlikely event that we have to cancel or reschedule a course due to tutors illness, absence or in any other circumstances, we will offer a full refund.

9b. Workshops

  1. If you find that you can’t make it on the day of the course but you give us at least 48 hours notice, you will be given the choice of a full refund or a credit for another course.

  2. If you can’t make it on the day but you give us at least 12 hours notice, you will be given a refund of 80% of the total paid for the course.

9c. Gavin MacDonald Photography reserves the right to cancel the workshop up to 28 days in advance of the workshop. If this is necessary we will if possible make arrangements with the client to transfer the booking to another workshop. If this is not possible a full refund will given.


9d. If the cancellation is out of the control of Gavin MacDonald Photography, e.g. natural disasters or tutor illness, we may give the client less than 28 days notice. The monies paid will be transferable to another workshop.

9e. We are at the mercy of the British weather, if poor or inclement weather is experienced when a workshop is in progress, it may necessitate an early finish - in such instances this is considered beyond the control of participants and Gavin MacDonald Photography. However, every effort will be made to provide indoor tuition as an alternative.


9f.  Gavin MacDonald Photography cannot accept responsibility for expenses incurred due to cancellations.

10. Insurance


All clients participate at their own risk and Gavin MacDonald Photography can accept no responsibility for injury or damage to their persons or property. It is recommended that the client obtains a standard holiday or public liability insurance policy to cover themselves against injury, theft or cancellation.

11. Itineraries
 

Any preset itinerary needs to be flexible. The weather, the tides and outside influences can alter the best laid plans. It may be necessary to change itineraries - should this happen, participants' understanding is greatly appreciated!

12. Legal Age


All participants must be 18 years or over on the day of the workshop. Under 18's are welcome to attend a workshop but must be accompanied by a participating adult.

13. Complaints

 

The client must communicate any perceived failure in the performance of this contract on the spot to the tour leader thus giving the tour leader the opportunity to achieve a satisfactory solution. Should this not be possible, you should make your complaint known to us in writing within 28 days of the completion of the workshop.

14. Applicable Law

All Contracts made between Gavin MacDonald Photography and you shall be governed by the laws of Scotland. You accept that the total liability to you on any matter whatsoever relating to the Contract or on any consequential loss relating to the Contract cannot exceed the total Contract price. Any dispute arising from the Contract must be confirmed by you in writing within 30 days. In the first instance you agree that you and we shall try to reach an amicable settlement via agreement or mediation; if these fail the dispute shall be subject to the exclusive jurisdiction of the Scottish courts.
